Terms of Service

1. The agreement

These Terms are an agreement between you and KYROPLAY PTE. LTD., a company registered in Singapore ("KyroPlay", "we", "us"), for your use of the KyroPlay app, the games made and played in it, and our website (the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy and the Community Guidelines below.

2. Who can use KyroPlay

You must be at least 13 years old, or the minimum age required to use online services without parental consent in your country if that is higher. If you are under 18 (or the age of majority where you live), you need permission from a parent or guardian, and they agree to these Terms for you and are responsible for purchases made with your account. You may not use the Service if we have previously banned you or if the law prohibits it.

3. Your account

• You can start as a guest and later add a sign-in method, such as your Google account. Guest accounts that are never linked to a sign-in method may be lost if you uninstall the app or change devices.
• Give accurate information, including your birth date, and keep it up to date.
• Keep your sign-in methods secure. You are responsible for activity on your account.
• Accounts are personal. Don't sell, share or transfer your account, or create accounts to evade a ban.

4. Creating with AI

• You describe a game and KyroPlay's AI builds it. Results depend on your instructions and can be imperfect, unexpected or similar to things other people make. Review what you create before you publish it.
• You are responsible for your instructions and the images you upload. Don't ask the AI to create content that breaks these Terms or the Community Guidelines, and don't try to bypass our safety systems.
• New builds are private versions that only you can play. Nothing is public until you choose to publish it.
• We may refuse, stop or remove a build that we believe breaks these Terms or could harm users or the Service.

5. Your content and remixes

"Your content" means what you submit or create on the Service, including prompts, images, games, titles, descriptions, comments and messages.

• You keep your rights. As between you and us, you own the rights you have in your content. We don't claim ownership.
• License to us. You give us a worldwide, non-exclusive, royalty-free license to host, store, run, reproduce, adapt (for example, to make it work on different devices), display and distribute your content, only to operate, improve and promote the Service. For private content, this license is limited to operating the Service for you. The license ends when your content is deleted, except for copies other users have remixed, backups kept for a limited time, or where the law requires us to keep it.
• Remixes. Published games can be remixed by other users when remixing is allowed. Remixing is on by default; members can turn it off for their games. By publishing a game that allows remixing, you give other users a license to use it as the starting point for their own games on KyroPlay. Remixes credit the original game. Turning off remixing, unpublishing or deleting a game doesn't remove remixes made before that.
• Your promises. You have the rights needed to share your content, and it doesn't infringe anyone's intellectual property, privacy or other rights.
• Copyright complaints. If you believe content on KyroPlay infringes your copyright, write to support[at]kyroplay.ai with the content's link, your work, and your contact details. We'll remove infringing content and may end the accounts of repeat infringers.

6. Community Guidelines

KyroPlay is for everyone aged 13 and up. These rules apply to all games (including what the AI generates for you), profiles, comments, messages, images and names. Don't create, publish or share:

• Child sexual abuse or exploitation of any kind. We have zero tolerance, remove it immediately, ban the account, and report it to the relevant authorities.
• Sexual or sexually suggestive content, including nudity.
• Graphic violence, gore or content that glorifies real-world violence, terrorism or violent extremism.
• Hate: content that attacks or demeans people based on race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation, age or similar characteristics.
• Bullying and harassment, threats, or targeting someone with unwanted contact.
• Self-harm or suicide promotion, or dangerous challenges.
• Illegal or regulated goods and activities, such as drugs, weapons, or real-money gambling.
• Scams, spam and malicious code, including games that try to trick players, collect their personal information or passwords, or harm devices.
• Personal information about others without consent, such as addresses, phone numbers or private photos.
• Impersonation and deceptive deepfakes of real people or organizations.
• Content that infringes someone else's copyright, trademark or other rights.

Also don't: cheat or manipulate scores, likes or rankings; interfere with or overload the Service; reverse engineer it or scrape it; or use it to build a competing service.

7. Reports and enforcement

• You can report any game, comment, message or user in the app, and block anyone. Blocked users can't message you or interact with you.
• We review reports and may use automated tools to help detect prohibited content. We may remove content, limit features, suspend or permanently ban accounts, and, where appropriate, notify law enforcement.
• If you think we made a mistake, write to support[at]kyroplay.ai and we'll take another look.

8. Credits and membership

• What Credits are. Credits are used to create and improve games and to generate game art. The app shows what an action uses before you start it where possible. Credits are a limited license to use features of the Service. They have no cash value and can't be exchanged for money, transferred, or sold.
• Buying. Credit packs and memberships are sold through Google Play (or the App Store on iOS), and the store's terms also apply to your purchase. Prices are shown in the app before you buy.
• Expiry. Purchased Credit packs stay valid for 36,500 days (about 100 years) from purchase. Credits included in a membership or given as a monthly or promotional allowance are valid for the period shown in the app and don't roll over. When you spend Credits, the ones that expire soonest are used first.
• Membership. Memberships renew automatically at the end of each period until you cancel. Cancel any time in your Google Play (or App Store) subscription settings at least 24 hours before renewal; you keep membership benefits until the end of the current period. Deleting the app or your account does not cancel a store subscription.
• Refunds. Except where required by law or the store's refund policy, purchases are final. Refund requests go through the store you bought from. If a purchase is refunded, we may remove the related Credits or benefits.
• Changes and ending. We may change what Credits are needed for or how many an action uses, and will show the current amounts in the app. Unused Credits are forfeited if your account is deleted or banned for breaking these Terms, unless the law says otherwise.

9. Our rights

The Service, including the app, the KyroPlay name and logo, our software, templates, art and sound libraries and website, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the Service according to these Terms. Feedback you send us may be used without obligation to you.

10. Third-party services

Some features rely on third parties, such as Google and Apple for sign-in and payments, and AI providers for building games. Their terms may also apply, and we are not responsible for their services.

11. Ending your use

You can stop using KyroPlay and delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if we stop providing the Service, in which case we will give reasonable notice where we can. Sections that by their nature should survive (such as licenses already granted to remixes, disclaimers and liability limits) continue after your account ends.

12. Disclaimers and limitation of liability

The Service, including AI-generated games and content made by other users, is provided "as is" and "as available". To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free, or that AI output will be accurate or fit for a particular purpose.

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or SGD 100. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory law.

You agree to compensate us for losses arising from your content or your breach of these Terms, to the extent permitted by law.

13. Governing law

These Terms are governed by the laws of Singapore. Disputes will be handled by the courts of Singapore, unless mandatory consumer law in your country gives you the right to bring a claim where you live. Before starting a dispute, please contact us so we can try to resolve it informally.

14. Changes to these Terms

We may update these Terms. We'll change the "Last updated" date above, and for material changes we will notify you in the app before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.

15. Contact
